1. Introduction
Welcome to the Beyond Survival Mode Program.
These Terms and Conditions govern the Beyond Survival Mode Program for your (“Client”, “you”, or “your”) signing up, taking part, and working with Mindful Synergi (“Provider,” “we,” “us,” or “our”).
We want working with us to feel down-to-earth and supportive. These Terms & Conditions establish the clinical boundaries, financial transparency, and legal protections required under law to ensure your safety and the professional integrity of our practice. Once you finish setting up, send in your assessment info, and pay for your booking, you are locked into this deal.
2. Program Scope & Delivery Structure
- The Onboarding Step: The Beyond Survival Mode Program begins with a comprehensive 116-question Schema Questionnaire. This intake framework evaluates your behavioral patterns and personality markers.
- The Free Valuation: The Schema Questionnaire and its resultant pattern report are delivered entirely as a free resource to help you uncover your core survival dynamics.
- The Consultation Booking: Upon reviewing your free results, you are given an opportunity to buy into a live, one-on-one professional consultation session (50 minutes) with a matched Mindful Synergi practitioner suited to your specific traits.
- Clinical Governance: All clinical aspects of this program, including practitioner allocation, risk escalation, and care standards, operate under the professional oversight of Sheree Simpson and the registered therapeutic team at Mindful Synergi.
3. Fees, Surcharges, and Billing Processing
- Session Investment: The single live matched consultation session is billed at a flat rate of $200 AUD.
- Taxation & Currency: All fees are processed in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST) in accordance with the A New Tax System (Goods and Services Tax) Act 1999 (Cth).
- Payment Mechanisms: Payments are processed securely upfront via our online checkout pipeline (utilising platforms such as Halaxy or Stripe) prior to booking confirmation.
- Default & Debt Recovery: In the highly unlikely event of a payment reversal, credit card default, or outstanding balance, you agree to be responsible for all reasonable administrative costs incurred during the standard collection process.
- Scope Exclusion: Your standard program fee strictly covers the 50-minute consultation. If you require formal reporting, progress letters, or clinical documentation for external bodies (such as employers, insurers, or legal representatives), additional professional report-writing fees apply. Forensic or court reports are explicitly excluded.
4. Strict 48-Hour Cancellation & Refund Policy (ACL Compliant)
We honour your time and create a dedicated space for you; in return, we ask that you respect our practitioners’ schedules. Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL).
- The Notice Requirement: To reschedule or cancel your scheduled consultation without a financial penalty, you must provide a minimum of 48 hours’ notice.
- Business-Hour Boundaries: To count as valid notice, your cancellation or rescheduling request must be submitted via text, phone call, or email to our administrative team strictly between 9:00 AM and 5:00 PM, more than 48 hours before the scheduled appointment. - Late Cancellations & No-Shows: If you give less than 48 hours’ notice, or fail to attend your scheduled session, the full $200 AUD fee will be charged, and the session will be forfeited. However, if Mindful Synergi is successfully able to fill your specific cancelled slot with another client within the same week, we will happily credit your fee.
- Change of Mind: Under the ACL, service providers are not legally required to provide a refund for a simple change of mind. Because your program enrollment instantly triggers administrative matching, refunds are not provided for a change of mind once a session is booked, though you may request an administrative transfer to an alternative date outside the 48-hour window.
5. Telehealth & Behavioral Boundaries
- Platform Delivery: Online sessions are conducted virtually via Halaxy, which complies strictly with Australian standards for medical-grade online encryption and digital privacy.
- Client Connectedness Responsibilities: You are solely responsible for ensuring you have a functioning internet connection, working audio-visual hardware (smartphone, tablet, or computer), and a quiet, entirely private space to protect your own therapeutic vulnerability and the safety of any minors who may be present.
- The Presence Agreement: To preserve clinical safety, you explicitly agree to avoid multitasking (e.g., driving a motor vehicle, operating machinery, or texting) during your live session. Practitioners reserve the right to immediately pause or reschedule a session at your cost if your current physical environment compromises your safety or focus.
6. Session Records & Digital Note-Taking (Heidi Health or NovoNote)
- Short Notes: We protect your therapeutic story closely. Mindful Synergi creates and maintains brief written session records to support your growth. These notes are highly secure, stored in encrypted systems, and separate from your direct public-facing identification.
- AI Medical Scribe Consent: To ensure our practitioners remain entirely present with you during your 50-minute consultation rather than staring at a keyboard, Mindful Synergi utilises Heidi Health or NovoNote (secure, encrypted AI medical scribe services).
- Audio Deletion: By participating in the session, you acknowledge and consent to Heidi Health or NovoNote securely processing the audio purely for professional note formulation. The raw audio recordings are never stored permanently and are completely deleted immediately after the clinical notes are generated.
7. Clinical Ethics, Professional Supervision, and PACFA Alignment
- Ethical Codes: All practitioners facilitating the Beyond Survival Mode Program strictly abide by the rigorous professional and ethical frameworks established by the Psychotherapy and Counselling Federation of Australia (PACFA) or the Australian Counselling Association (ACA) or the Australian Health Practitioner Regulation Agency (Ahpra).
- Supervision Boundaries: For ongoing professional development and to maintain the highest quality of therapeutic care, case components may be discussed confidentially within professional clinical supervision. During these sessions, all identifying details (names, specific locations, identifying landmarks) are completely omitted to maintain your anonymity.
- Practitioner-Client Fit Protocol: Human connection is at the heart of healing. It is clinically possible that a practitioner may determine they are not the best fit for your specific behavioural patterns or trauma-informed needs. If this occurs, it is never a personal reflection on you; rather, it is an ethical responsibility to ensure you receive optimal care. Mindful Synergi will carefully manage an appropriate conclusion and actively refer you to an aligned specialist.
8. Explicit Limits of Confidentiality & Mandatory Reporting
The contents of your questionnaire responses and live consultations are deeply confidential. Information cannot be shared with third parties without your explicit, written consent. However, under Australian statutory regulations, confidentiality must be breached under the following strict legal exceptions:
- Duty to Warn and Protect (Harm to Self or Others): If a client discloses a clear intention or explicit plan to cause serious harm to another person, the practitioner is legally required to warn the intended victim and notify legal authorities. Similarly, if a client discloses or strongly implies an imminent plan for suicide or self-harm, the practitioner is required to notify legal authorities and make reasonable attempts to contact the client’s family or emergency contacts to ensure immediate physical safety.
- Abuse of Children and Vulnerable Adults: In strict compliance with Australian state and territory mandatory reporting legislation, if a client states, implies, or suggests that a child or vulnerable adult is actively experiencing abuse, or is at serious risk of abuse and neglect, the professional is legally required to immediately file a report with appropriate social services and law enforcement authorities.
- Legal Subpoenas & Criminal Activity: Your records may be accessed if Mindful Synergi is served with a legally binding court order or subpoena, or where a disclosure is explicitly mandated under Australian criminal law.
9. Crisis & Emergency Support Disclaimer
- Not a Crisis Intervention Space: Mindful Synergi and the Beyond Survival Mode Program are structured therapeutic growth systems; we are not an emergency crisis intervention service. We cannot provide immediate, after-hours emergency services..
- Emergency Contact Directives: If you are experiencing an acute mental health crisis, overwhelming psychological distress, or feel at risk of self-harm, please close this platform and seek immediate care through one of the following 24/7 dedicated Australian emergency channels:

10. Empathetic Behavioral Policy & Safe Space Agreement
- The Right to Respect: At Mindful Synergi, we firmly believe every client has a fundamental right to be heard, safely understood, and deeply respected. We understand that unpacking survival mechanisms can uncover intense anger, emotional pain, and distress. We do not view an interaction as unacceptable simply because a client is forceful, determined, or highly emotional about their situation.
- Unacceptable Behavioural Boundaries: However, to protect the mental health and psychological safety of our practitioners and staff, we enforce a strict zero-tolerance boundary against:
- Aggressive or Abusive Behaviour: Language (written or verbal) intended to intimidate, threaten, abuse, or bully our staff, including discriminatory, derogatory, or inflammatory remarks.
- Unreasonable Demands: Continuous, excessive contact across phone or email channels that disrupts clinical workflows and directly disadvantages other program participants.
- Procedural Fairness & Restrictive Actions: If boundaries are breached, we will always handle it calmly, fairly, and step-by-step before making any final changes. First, we will let you know what the issue is and give you a chance to sort it out. If the behavior keeps happening, we might have to end our call right away, move our contact strictly to specific email days, or end your program altogether. If we do have to limit things, we will put it all in writing to explain exactly why, and help you find other support options.
11. Limitation of Liability
- To the extent permitted by law, the Provider is not liable for indirect or consequential losses arising from the use of the program.
- Our total liability for any claim is limited to the total amount paid by you in the 12 months preceding the claim.
12. Force Majeure
The Provider is not liable for delays or disruptions caused by events beyond our reasonable control, including illness, natural disasters, government restrictions, or technical failures.
13. Amendments
We reserve the right to amend these Terms and Conditions. Changes will be communicated via email and will take effect 30 days after notification.
14. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue in full force.
